So I, as many others, was really excited for fallout 76. As a result, I preordered back in April. When the beta rolled around I was excited to install it and play it. I’m on PC so I went to install the Bethesda.net launcher. I was greeted with the worst user experience ever. I never was able to use the interface. It was always just white. After hours of scouring the internet and working with support, I gave up, and never played the beta. The game released and I went through that same thing again. Nothing worked. At this point I am very frustrated that I cannot even play a presumably shitty game (from what I’ve heard) I payed $60 for. So I contact support in an effort to get a refund for the game I was never even able to install. This is what I sent:

“I never was able to install the game. I want a refund.”

Short Sweet And to the point

I figured they would just give me my money back and all would be good. As I’m waiting for response, I start reading all about the controversy surrounding Bethesda and their refund policy. And I start to get worried. About a day and a half later I get this:

“Greetings,

Thank you for contacting the Bethesda Support Team.

Customers who have downloaded the game are not eligible for a refund. We apologize for the inconvenience.

If there is anything else we can assist you with please reply to this email for further assistance.

Thank you for your patience.

Kind Regards,

Bethesda Support”

Im really pissed at this. I realize that this is an automated response to any refund request involving the digital copy of the game and they didn’t even read it. So I reply hoping to actually talk to someone and get this cleared up. I say this:

“I haven't downloaded the game, so it shouldn’t be a problem”

I get no response. 7 days later I reply to the ticket again. No response. So I open a new ticket and go into extensive detail on why I am eligible for a refund. I say this:

I replied explaining I never downloaded the game, and never got a response. I went and checked the terms and service and found this:

"Once You have redeemed Downloadable Content, that Content is not returnable, exchangeable, or refundable for other Content or for cash, other goods or services unless approved by ZeniMax or required by applicable law and subject to the Statutory Obligations (as defined in Section 1); for example, if ZeniMax downloaded the wrong Content to You, You may be entitled to a refund. Unless otherwise specified by ZeniMax in writing and unless otherwise prohibited by applicable law and subject to the Statutory Obligations (as defined in Section 1), Downloadable Content may expire upon the earlier of (a) the closure of an Account, or (b) the later of one hundred and eighty (180) days past (i) the most recent Account login by You or (ii) the end of Your subscription or membership for the applicable Service if such subscription or membership is not renewed."

While it doesn't make it clear, I assume redeeming content on pc would be downloading the game. I never downloaded the game because my bethesda.net launcher is broken. I've tried several things with support, but nothing worked. Instead, I would rather just have a refund, which I should be eligible for since I never downloaded the game. As for the 180-day rule, I purchased the game on August 18, 2018, 113 days ago. Therefore, according to your own terms of service, I am allowed to get a refund.

date_time_incident = Hi. I was never able to download Fallout 76. I would like a refund. Your terms of service states that if a purchased item has not been downloaded within 180 days, a refund may be given. I am well within that threshold. I want my money back.”

And this is their response:

I’m fu*king done with Bethesda. I want my money back. Anyone know a better way I could go about this? Thanks.
